Welcome to monkeydo!
Thanks for using monkeydo ("the App"), a focus timer for iPhone and iPad. The App is made and run by one person ("I", "me", "my"), identified under Ownership and contact at the end of this document. By using the App you are agreeing to these terms. Please read them carefully. IF YOU DO NOT AGREE TO THESE TERMS, PLEASE DO NOT USE THE APP.
You must be at least 13 years old to create an account. If you are a minor in your country, you need a parent or guardian's permission.
Using monkeydo
You may use the App only as permitted by law and by these terms. Do not interfere with the App or try to access it by any method other than the interface I provide.
Using the App does not give you ownership of any intellectual property in it. The monkey sprites, card art, fonts, sounds, layouts and code are mine. You may use them inside the App and nowhere else. These terms grant you no right to use the monkeydo name or logo. Do not remove or alter any legal notices displayed in the App.
Most of the App works with no account at all. Timers, tasks, monkeys and the tree run entirely on your device. Signing in is needed only for Squads and for syncing across devices.
Your account
Sign-in is handled by Apple or Google. I never see or store your password. You are responsible for what happens under your account, so keep your device secure, and tell me at support@monkeydo.online if you think someone else is using it.
Usernames are permanent. A username must not impersonate anyone, contain slurs, or be chosen to mislead. I may reclaim a username that breaks this rule.
You can delete your account inside the App at any time, at Sidebar, your profile, ..., Delete Account.
What you may not do
Do not:
- post content that is illegal, hateful, harassing, sexual or violent, including in drawings;
- harass, stalk or impersonate another user;
- cheat, meaning manipulate your stardust, focus time or leaderboard position by any means other than actually using the timer, including by modifying the App or calling its backend directly;
- attempt to access another user's data, or probe, scan or overload the service;
- reverse engineer, decompile or resell the App;
- use the App to build a competing product, or scrape its data;
- file false reports. The Report button exists to protect people, and abusing it makes it less useful for everyone;
- exploit bugs. If you find a way to generate stardust, bananas or card art that clearly is not intended, tell me at support@monkeydo.online rather than farming it;
- trade accounts, currencies or card art for money or anything else, inside or outside the App.
I may suspend or delete any account that breaks these rules, without notice where the breach is serious. Where it is not, I will tell you first.
Your content
Usernames, squad names, mottos, descriptions and drawings are yours, and you keep ownership of them.
Drawings work slightly differently, because the sketch tool does not let you draw freely. It stamps my artwork wherever you tap. The arrangement is yours: which stamps you chose, in which colours, placed where. The stamp artwork stays mine. You may use your drawings freely for personal, non-commercial purposes. Commercial use needs my permission, because it would be commercial use of my artwork. Ask me at support@monkeydo.online and I am likely to say yes.
The emotes in squad chat are my artwork, not Unicode emoji — twelve are available to everyone and a few more can be unlocked in the Shop with in-app currency. They stay mine. Unlocking one is a licence to send it inside monkeydo, the same as any other cosmetic; it does not transfer ownership and does not let you use the artwork elsewhere. Messages sent by much older versions of the App may still contain a plain Unicode emoji, which your device draws with its own emoji font.
You grant me a non-exclusive, worldwide, royalty-free licence to store, display and transmit your content only so far as is needed to operate the App, for example showing your drawing to your squadmates. That licence ends when you delete the content or your account, with two narrow exceptions: copies already delivered to other people, which sit on their device until the next daily reset, and routine backups, until they expire on their normal schedule. Neither exception lets me keep displaying or using your content after you delete it.
You are responsible for what you post.
Moderation, reporting and blocking
There is zero tolerance for objectionable content and abusive users. Content that breaks What you may not do is removed, and the account that posted it may be suspended or terminated without notice.
Available to you in the App:
- Report. Every message, drawing and profile has a Report action.
- Block. You can block any user. A blocked user's messages, drawings and profile are hidden from you, and they cannot message you.
- Leave or remove. You can leave any squad, and squad owners can remove members.
- Contact. Write to support@monkeydo.online about anything a report cannot cover.
I act on reports within 24 hours of receiving them, by removing content, suspending an account, or deciding no action is needed. I filter content on submission where I reasonably can, but automated filtering is imperfect and I am not obliged to monitor proactively. Repeatedly posting objectionable content, or evading a block or suspension, ends your access permanently.
Squad chat resets every day
Squad chat is ephemeral by design. Every message is deleted once a day at 00:00 US Eastern time, at the same moment worldwide, and the App shows you that moment in your own local time. Nothing is archived. Do not use monkeydo to store anything you need to keep.
Purchases
The App is free to use. There are two separate things you can pay for, and they work differently. Both are processed entirely by Apple. I never receive your payment details, and all refunds are handled by Apple under the Apple Media Services Terms. Request one at reportaproblem.apple.com.
Tips
The "Support monkeydo!" purchases are optional tips. They are consumable, meaning each one is a single separate tip and you may give as many as you like. They unlock nothing at all: no icon, no feature, no currency, no advantage. Because there is nothing to restore, they are not restorable, and they do not reappear when you reinstall.
monkeydo+
monkeydo+ is an auto-renewing subscription offered monthly and yearly. Length, price in your local currency, and exactly what is included are shown on the subscription screen before you are asked to buy.
- Payment is charged to your Apple Account at confirmation of purchase.
- The subscription renews at the end of each period, at the same price, until you cancel. Your account is charged for renewal within 24 hours before the end of the current period.
- Cancel any time in iOS Settings, your name, Subscriptions, or through Manage Subscription in the App. Cancelling stops the next renewal. It does not refund the period you are in.
- If you cancel, paid features stop when the period ends. Nothing you earned by focusing is taken away. Your stardust, monkeys, museum and cards are yours whether or not you subscribe.
I will not raise the price of a subscription you already hold without telling you first and giving you the chance to cancel.
In-app currencies and card art
Bananas, polychrome bananas, stardust and any other in-app currency are a licence to use a feature within the App. They are not money, not property, not transferable, not redeemable for cash, and have no value outside the App. They cannot be bought with money. They are earned by focusing. Unused balances are forfeited if your account is closed. Bananas and shop upgrades reset at the end of each calendar month, and unspent bananas convert to polychrome bananas at a rate published in the Shop.
Rehatching a monkey costs bananas and gives a randomly selected card art. The odds are shown in the Shop before you spend anything. Card art is cosmetic, confers no advantage, and has no value outside the App. Odds may change when new art is added, and the current odds are always the ones shown in the Shop.
Profile icons and chat emotes are also bought with in-app currency, at a fixed price shown in the Shop — there is nothing random about those. Like card art they are cosmetic, confer no advantage, and have no value outside the App. Purchases made with in-app currency are not purchases of money's worth and are not refundable.
Privacy
The Privacy Policy explains what I collect and why, and forms part of these terms. In short: the App works fully offline with no account, usage statistics are off unless you turn them on, and I do not sell your data.
Changes to the App and these terms
I may add, change or remove features, including in-game currencies, monkeys, seasons and squads. Cosmetic content may be added, altered, retired or replaced at any time, and no specific artwork is promised to remain available. I will give reasonable notice before removing something you paid for.
I will post changes to these terms in the App and at monkeydo.online. Ordinary changes take effect 7 days after posting. Changes that materially affect your rights, such as pricing, what happens to purchases, or dispute resolution, take effect 30 days after posting, and I will say so plainly when I post them. If you keep using the App after a change takes effect, that is your acceptance of it. If you would rather not, you can stop and delete your account.
No warranty
The App is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. I do not warrant that the App will be uninterrupted, timely, secure, error free, or that your data will never be lost. monkeydo is a study timer written by one person, so back up anything you care about.
Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you.
Limitation of liability
To the maximum extent permitted by law, in no event shall monkeydo or its developer be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data, goodwill or study progress, arising out of or relating to your use of the App.
In no event shall my total aggregate liability for all claims relating to the App exceed the greater of (a) the total amount you paid me through the App in the twelve months preceding the event giving rise to the claim, or (b) fifty United States dollars (US$50). This limit applies regardless of the theory of liability and even if I was advised of the possibility of such damages.
Some jurisdictions do not allow these limits. Several US states do not permit the exclusion of incidental or consequential damages, and in the EU and UK liability for death, personal injury, gross negligence or wilful misconduct cannot be excluded. Nothing here purports to exclude anything that cannot lawfully be excluded.
monkeydo is a focus timer, not medical advice. It is not a diagnosis of, or a treatment for, ADHD or any other condition.
Indemnification
You agree to indemnify, defend and hold harmless monkeydo and its developer from and against any claims, damages, liabilities, losses and reasonable legal fees arising out of or related to (a) your use or misuse of the App, (b) content you post, (c) your breach of these terms, and (d) your violation of any law or of any third party's rights.
I will tell you promptly about any such claim and you may control the defence, provided you do not settle in a way that admits fault on my behalf without my written consent.
Termination
You may stop using the App at any time and delete your account in the App.
I may suspend or terminate your account or access to the App at my discretion, with or without cause, and with or without notice. In practice I will give reasonable notice where it is practical, but not where notice would risk harm to other users or to the service, and not where the account is being used to break What you may not do.
If I receive a credible report that an account has been compromised or is being used to exploit the App, I may suspend it while I look into it. That is a pause, not a decision. If the account turns out to be fine, I restore it and you lose nothing.
If I discontinue the App entirely, I will give reasonable notice through the App or the App Store listing where I can.
Terminating your account does not entitle you to a refund. Refunds are Apple's to give. Your content, Purchases, No warranty, Limitation of liability, Indemnification, Disputes and Copyright survive termination.
Disputes
Please read this section carefully. It affects how disputes between us are resolved, and it limits your right to bring a lawsuit or a class action.
Governing law
These terms are governed by the laws of the State of Michigan, United States, without regard to its conflict of laws rules, and by the Federal Arbitration Act as to Agreement to arbitrate.
Talk to me first
Before starting arbitration or filing anything, email support@monkeydo.online with a short description of the problem and what you would like done. We both agree to try in good faith to resolve it informally for 30 days before going further. This step is a precondition to arbitration for both of us.
Agreement to arbitrate
If we cannot resolve it informally, you and I agree that any dispute arising out of or relating to these terms or the App will be resolved by binding individual arbitration, and not in court, except as stated in What is not arbitrated.
- Arbitration is administered by the American Arbitration Association under its Consumer Arbitration Rules, available at adr.org.
- Arbitration is individual. An arbitrator may award relief only to you, in your individual capacity, and only to the extent needed to resolve your own claim.
- Arbitration may be conducted by documents, by telephone or video, or in person in the county where you live, at your choice.
- I will pay the filing, administration and arbitrator fees for any claim under US$10,000, unless the arbitrator finds your claim frivolous.
- The arbitrator's decision is final and may be entered as a judgment in any court with jurisdiction.
Class action waiver
You and I each waive any right to bring or participate in a class, collective, consolidated or representative action. Neither of us may act as a class representative or member, or join claims with any other person.
If a court decides this waiver is unenforceable as to a particular claim, that claim alone leaves arbitration and proceeds in court, and the rest of this section still stands. If the waiver is found unenforceable in its entirety, then Agreement to arbitrate does not apply and all disputes go to court.
What is not arbitrated
Either of us may always bring an individual claim in small claims court, if it qualifies, and may seek an injunction in court to stop misuse of intellectual property or a security breach. Nothing here waives any right you have to report conduct to a government agency.
For anything outside Agreement to arbitrate, the exclusive venue is the state and federal courts in Washtenaw County, Michigan, and you consent to personal jurisdiction there.
How to opt out of arbitration
You may opt out of arbitration and the class action waiver with no effect on the rest of these terms. Email support@monkeydo.online with the subject line "Arbitration Opt-Out", your username, and a statement that you are opting out, within 30 days of first accepting these terms. Opting out is free, changes nothing else about your account, and I will confirm by reply.
Users outside the United States
If your home country's law gives you consumer protections that cannot be waived by contract, which includes consumers in the European Union and the United Kingdom, those protections apply to you regardless of anything in this section, and arbitration and the class action waiver do not apply to you to the extent they conflict with them. You may bring proceedings in your own country's courts where its law gives you that right.
Apple
This section contains the terms Apple requires in a developer's own end user licence agreement.
Acknowledgement. These terms are between you and me, not Apple, and I alone, not Apple, am responsible for the App and its content.
Scope of licence. I grant you a non-transferable licence to use the App on any Apple-branded product that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms of Service. The App may be accessed by other accounts associated with you via Family Sharing or volume purchasing. This licence does not let you distribute the App over a network where it could be used by several devices at once.
Maintenance and support. I am solely responsible for providing any maintenance and support, at support@monkeydo.online. Apple has no obligation whatsoever to furnish any maintenance or support for the App.
Warranty. I am solely responsible for any product warranties, whether express or implied by law, to the extent they are not effectively disclaimed above. If the App fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price of the App to you. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are my sole responsibility.
Product claims. I, not Apple, am responsible for addressing any claims by you or a third party relating to the App or your possession and use of it, including product liability claims, any claim that the App fails to conform to an applicable legal or regulatory requirement, and claims arising under consumer protection, privacy or similar legislation.
Intellectual property. If a third party claims that the App or your possession and use of it infringes that third party's intellectual property rights, I, not Apple, am solely responsible for the investigation, defence, settlement and discharge of that claim.
Legal compliance. You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
Third party terms. You must comply with any applicable third party terms of agreement when using the App, for example your wireless data plan's terms.
Third party beneficiary. Apple and Apple's subsidiaries are third party beneficiaries of these terms and, upon your acceptance, have the right to enforce these terms against you.
Copyright
If you believe content in the App infringes your copyright, send a notice to support@monkeydo.online including: your physical or electronic signature; identification of the copyrighted work you say is infringed; identification of the material you say is infringing, and where to find it in the App; your address, telephone number and email; a statement that you believe in good faith the use is not authorised by the copyright owner, its agent, or the law; and a statement, under penalty of perjury, that the information is accurate and that you are the owner or authorised to act for the owner.
I will remove or disable access to the material expeditiously and notify the user who posted it, who may send a counter notice to the same address. Misrepresenting infringement can make you liable for damages under 17 U.S.C. section 512(f). I terminate the accounts of users who repeatedly infringe copyright.
Everything else
If any part of these terms is unenforceable, the rest stays in force. My not enforcing a right is not a waiver of it. You may not transfer your rights under these terms. I may transfer mine if the App changes hands, with notice to you. These terms are the entire agreement between us about the App, and they do not create any third party beneficiary rights other than Apple's, described above.
Ownership and contact
monkeydo, its code, its artwork and the associated intellectual property are owned by Sophie Hu, an individual developer in the United States. "I", "me" and "my" in these terms mean that person.
